This Privacy Policy describes how Before Noon AI, LLC ("Before Noon AI," "Company," "we," "us," or "our") collects, uses, and protects information in connection with your use of our voice-based artificial intelligence services, applications, websites, and related offerings (collectively, the "Service").
By using the Service, you consent to the practices described in this Privacy Policy.
1. Scope of This Policy
This Privacy Policy applies to information collected through the Service.
The Service is designed for personal productivity and executive communication assistance. It is not intended for use in regulated, clinical, medical, or patient-care environments, and should not be used to process protected health information or other regulated data.
2. Information We Collect
a. Information You Provide
We may collect information you voluntarily provide, including:
- Account information (such as name, email address, phone number)
- Voice inputs, instructions, and preferences
- Contact information you choose to upload or reference
- Communications sent through or to the Service
- Audio, transcripts, and related metadata from conversations captured through a wearable device or other ambient-capture tool you choose to use with the Service (including an Omi device)
b. Automatically Collected Information
When you use the Service, we may automatically collect:
- Device and browser information
- Usage data and interaction logs
- Call metadata (such as timestamps, duration, and routing information)
- Approximate location inferred from IP address
c. Payment Information
If you subscribe to a paid plan, payment information is processed by third-party payment processors. We do not store full payment card details.
3. How We Use Information
We use information to:
- Provide, operate, and maintain the Service
- Enable voice interactions and communications
- Improve functionality, reliability, and user experience
- Communicate with you about the Service
- Detect, prevent, and address misuse or technical issues
- Comply with legal obligations
We do not use your information to provide medical, legal, financial, or other professional advice.
4. AI Processing and Limitations
The Service uses automated systems and artificial intelligence to process inputs and generate outputs.
You acknowledge that:
- AI outputs may be inaccurate or incomplete
- The Service is designed for assistance, not decision-making
- You remain responsible for how outputs are used
5. Data Retention
The Service is designed for conversational assistance, not permanent recordkeeping.
Accordingly:
- Some data may be retained only temporarily
- Data may be deleted automatically or upon user request
- The Service is not intended for compliance archiving or regulated data retention
Retention periods may vary based on operational needs, legal requirements, and user settings.
6. Sharing of Information
We may share information:
- With service providers and sub-processors who support the Service (such as cloud infrastructure, telecommunications and voice providers, language model providers, our wearable-capture partner Omi, and analytics services). A current list is published on our sub-processors page
- To comply with legal obligations or enforce our Terms
- In connection with a business transaction such as a merger, acquisition, or asset sale
We do not sell personal information.
7. Third-Party Services
The Service may interact with third-party systems, including telecommunications carriers, messaging providers, calendar services, our wearable and ambient-capture partner Omi, and other platforms. Where you use an Omi device with Before Noon, audio, transcripts, and related metadata captured through that device may be processed and stored by Omi in accordance with their own privacy policy and terms.
Before Noon AI does not control and is not responsible for:
- Privacy practices of third parties
- Availability or security of third-party services
- Data handled by third-party systems under their own terms
Your use of third-party services is governed by their respective privacy policies.
7A. Recording, Wiretap, and Consent Laws
The Service — including ambient or wearable capture through our partner Omi and any call recordings or transcripts created in connection with the Service — can result in the recording and transcription of conversations between you and other people.
Recording laws are not uniform. The federal standard and most U.S. states follow a one-party consent rule, while a smaller group of states — including California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington — generally require all-party (sometimes called two-party) consent.
As between you and Before Noon AI, you are solely responsible for knowing the laws of the jurisdictions where you and the other parties to your conversations are located, and for providing any notice and obtaining any consent those laws require before any conversation is recorded, intercepted, or transcribed through the Service. Before Noon AI does not provide legal advice on which rules apply to you. See Section 3A of our Terms of Service for the full provision.
8. Prohibited and Regulated Data
You agree not to provide:
- Protected health information
- Medical records or patient data
- Information subject to industry-specific regulatory requirements
The Service is not HIPAA-compliant and is not designed to process regulated data.
9. Data Security
We implement reasonable administrative, technical, and organizational measures designed to protect information. However, no system can be guaranteed to be completely secure.
You use the Service at your own risk.
10. Your Choices
Depending on the Service features available, you may:
- Update account information
- Manage communication preferences
- Request deletion of certain data
Requests may be subject to legal or operational limitations.
11. Children's Privacy
The Service is not directed to children under 18. We do not knowingly collect personal information from children.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised policy.
